Section G- Conditions     
     
1. Independence of the Foundation and the organization receiving the financial aid     
     The Foundation and the organization receiving the financial aid are independent of one another and must remain so at all times; they are not and must not be presented as agent or partner or as forming a joint enterprise with the other. No representation is to be made or act performed by the organization receiving the financial aid or the Foundation that might affirm or imply an apparent relationship as joint enterprise or partnership; neither the Foundation nor the organization receiving the financial aid may be bound in any way whatsoever by understandings, guarantees or representations of any kind made by the other party to any third party or in relation to any other act performed by the other party.     
     
2. Project     
     Unless otherwise stipulated in writing by the Foundation, the organization receiving the financial aid must use the funds to carry out the project described in the application. The organization benefiting from the financial aid may not make any change to the project without first receiving written approval from the Foundation. The organization receiving the financial aid must implement the project in compliance with all laws and all federal, provincial and municipal regulations, and with the municipal ordinances, rules and regulations applicable to the project. The work must be done by a general contractor holding an appropriate license from the Régie du Bâtiment du Québec.     
     
3. Transfer of the financial aid     
     The organization receiving the financial aid may not transfer this application for financial aid in whole or in part to another entity without first receiving the written consent of the Le Support – Fondation de la déficience intellectuelle.     
     
4. Unused funds     
     The organization receiving the financial aid agrees that any amount of the financial aid that is not used, or for which it has not accounted, belongs to the Le Support – Fondation de la déficience intellectuelle; these funds must be used only for the purposes agreed upon with the Foundation or be immediately returned to the Foundation upon its request.     
     
5. Cancellation or request for repayment of the financial aid      
     The Foundation reserves the right to cancel the financial aid and/or to ask that all or part of the financial aid granted be returned if the recipient of the financial aid: (i) does not begin or complete the project; (ii) knowingly provides false or deceptive information, whether in the application for financial aid, in any other communication with the Foundation, in any public communication regarding the project; (iii) violates any condition governing the financial aid; (iv) initiates or is the object of a suit for bankruptcy or is declared bankrupt. If the Foundation asks for repayment of all or part of the financial aid, the amount claimed is then considered by the Foundation to be a debt owing, and the recipient of the financial aid must pay this amount immediately.     
     
6. Indemnification     
    The organization receiving the financial aid agrees to hold the Foundation and its directors, executives, employees and representatives harmless against any claim, demand, expense, proceedings, action or other liability concerning material damages or bodily injury (including death) that may derive from the project or be related to it in any way. The organization receiving the financial aid further agrees to hold the Foundation and its directors, executives, employees and representatives     
harmless against any damage (ancillary, indirect, particular or consecutive) or any loss of enjoyment, revenue or profit that might be suffered by a person, a corporate body or an organization, including the Foundation, and that might derive from the project or be related to it in any way.     
     
7. Insurance     
     The organization receiving the financial aid agrees to take out and maintain at its expense, for the entire period covered by the project, all necessary insurance that would be considered appropriate for a prudent recipient of this kind, including a general liability policy and risk insurance for building contractors. Before undertaking the project and for its entire duration, the organization receiving the financial aid must provide to the Foundation a valid insurance certificate that mentions the project.     
     
8. Demolition or termination of the installation     
     The recipient of the financial aid must not sell, rent or transfer the installation in any other way (understood as the land, the building or the construction, as the case may be, that is the subject of the project described in the application), in whole or in part, nor demolish the installation or any construction that is part of the installation without obtaining the written consent of Le Support – Fondation de la déficience intellectuelle. The recipient of the financial aid must not mortgage or burden the installation for an amount exceeding the total value of the installation minus the amount of the financial aid.     
     
9. Dissolution of the owner organization     
     In the event that the organization that owns the building is dissolved, the organization must repay the financial aid granted by Le Support – Fondation de la déficience intellectuelle for the acquisition and/or renovation of the building. The Foundation will also have a right of first refusal to buy back the building.     
     
10. Acknowledgement     
     The organization receiving the financial aid agrees to acknowledge Le Support – Fondation de la déficience intellectuelle’s support in all its announcements and publicity relating to the project, on all worksite signage, and permanent tributes honouring the donors placed on the premises, using the following wording: “This project enjoys the support of the Le Support – Fondation de la déficience intellectuelle.” In addition, the organization receiving the financial aid undertakes to give its express and unrestricted authorization to any use of said grant of financial aid for publicity purposes by or on behalf of the Foundation.     
     
We ask that you acknowledge our financial support in proportion to the amount granted to you.     

Example:     
     
$5,000 or less:

  1. Acknowledgement of the aid received on your Web site and/or Facebook account, insertion of our logo and a link to our Web site    
  2. Acknowledgement of the aid received and Le Support – Fondation de la déficience intellectuelle logo in your organization’s in-house newsletter and in your annual report    
  3. Le Support – Fondation de la déficience intellectuelle logo printed on your posters, program or other promotional material(s) associated with your project    

     
$5,000 to $10,000: 1-2-3 plus 4 – Issue of a press release in the local media in collaboration with the Le Support – Fondation de la déficience intellectuelle  
$10,000 to $20,000: 1-2-3-4 plus 5- Handover of the official cheque with photos, with Le Support – Fondation de la déficience intellectuelle’s collaboration   
$20,000 and over: 1-2-3-4-5-plus 6- Press conference held with Le Support – Fondation de la déficience intellectuelle’s-collaboration   
     
When financial aid is granted to your organization, you agree to meet the following conditions:     
     

  1. No part of this financial support will be used to benefit an individual;     
  2. No change has been made in your organization in terms of its mission, its nature or the way it operates since the date of your application;     
  3. No change will be made in the supported project in its development or its budget allocations without informing the Foundation in advance. Any change must be authorized by our organization.     
  4. No surplus amount may be allocated to another project. You must return all unused funds to the Foundation;     
  5. If your project is postponed by more than six (6) months from the specified date, you must return to us the entire amount granted and submit a new financial aid application;     
  6. You must send us a copy of the invoices showing the expenses incurred in regard to your application;     
  7. With regard to the visibility given to our support, please inform us of any promotional or informational event highlighting the donation from our Foundation to your organization by calling us at 514-725-9797, extension 236;     
  8. You must send us a copy of the press review and any other communications document (in-house newsletter, brochure, poster, etc.) acknowledging the financial support granted;     
  9. Acknowledge on your organization’s Web site the Foundation’s contribution to your project, insert its logo and a link to its site     
  10. Provide photos illustrating your project, copyright-free, so that the Le Support – Fondation de la déficience intellectuelle can post them on its donation boxes and on its vehicles and use them in internal and external communications. The goal is to give donors and the general public some specific examples of the projects you carry out and to promote a positive and dynamic image of people living with an intellectual disability. As the signing organization, you acknowledge that you hold all legal authorizations to distribute the photos that you send to us and the people appearing in them and/or the holders of those rights agree to your sharing them with the Le Support – Fondation de la déficience intellectuelle. Same procedure for sending short videos. 

    
IMPORTANT: Any application for financial aid submitted to the Le Support – Fondation de la déficience intellectuelle binds the applicant in advance: (1) to meet all conditions associated with the granting of said financial aid by the Foundation and (2) to provide its express and unrestricted authorization to any use of said financial aid for publicity purposes by or on behalf of the Foundation.
